Procedure for handling seafarer claims and complaints
Required under MLC 2006. This is Seamar's formal procedure for receiving, reviewing and responding to any claim or complaint from a seafarer employed through the agency.
Purpose
The purpose of this procedure is to set out the rules for accepting, reviewing and responding to claims and complaints submitted by seafarers employed through the agency, and to ensure the entity providing shipboard employment services takes appropriate action.
Scope
This procedure applies whenever a seafarer submits a claim or complaint against the entity (the Agent) providing recruitment and maritime employment placement services.
Input
The procedure is initiated by a written claim or complaint submitted by a seafarer employed through the agency, addressed to the Crew Operator or the Director of the entity providing recruitment services. A submission made through the online form below counts as a written complaint for this purpose.
Process
- 4.1The complaint is accepted in writing, including submissions made through the online form on this page.
- 4.2The complaint is logged in the complaints and claims register.
- 4.3The complaint is analysed and its merits verified.
- 4.4A position is taken and a written response prepared within 14 days of receiving the complaint.
- 4.5If additional fact-finding is required, this deadline may be extended, and the complainant is informed accordingly.
- 4.6The process concludes with the formal closure of the case.
- 4.7Full documentation relating to the case is archived.
Output
The outcome of the procedure is a written response from the Crew Operator or Recruitment Manager, setting out the position on the claim or complaint raised.
Responsibility
The Crew Operator or Recruitment Manager is responsible for the correct handling of the claims and complaints process, and must ensure it is conducted diligently, on time, and in compliance with applicable regulations and standards.
Documentation
The following is maintained and archived: the original written claim or complaint, a certified copy of the written response, the complete set of documents relating to the case, and the complaints and claims register.
